Terms & Booking Conditions

These Terms & Booking Conditions (the "Terms") govern the live-streaming, recording and production services (the "Services") provided by BROWNZ MEDIA SERVICES LTD ("Brownz Media", "we", "us" or "our"), a company registered in England and Wales under company number 17225531, with its registered office at 79 Malvern Avenue, Ellesmere Port, CH65 5AQ.
They apply to any club, league, venue, organiser or individual who books us (the "Client", "you"). By confirming a booking you accept these Terms. The specific scope, dates and fees for your event are set out in the written quote or booking confirmation we provide, which forms part of these Terms; if anything in your quote conflicts with these Terms, the quote takes precedence.
1. Quotes and bookings
- We provide a written quote based on the event details you give us. Unless stated otherwise, a quote is valid for 30 days.
- A booking is confirmed once you accept the quote in writing (including by email) and, where we ask for one, pay any deposit.
- You are responsible for ensuring the event details you give us — venue, date, timings, format and access — are accurate. Changes may affect the fee.
2. Fees, deposits and payment
- The fee, any deposit, travel and expenses, and the payment schedule are set out in your quote. Travel within the UK is covered as described in your quote.
- Any deposit secures your date and, unless stated otherwise, is non-refundable if you cancel (see section 3).
- Invoices are payable by the date stated on the invoice. We may charge interest on late payments in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
- We are not currently registered for VAT, so no VAT is added to our fees. If this changes we will make it clear on our quotes and invoices.
3. Cancellation, rescheduling and force majeure
- If you cancel, any deposit is non-refundable, and cancellations made close to the event date may incur a charge of up to the full booking fee, as set out in your quote, to cover committed time and travel.
- If we have to cancel for reasons within our control, we will refund any fees you have paid for the cancelled event in full. That refund is your sole remedy.
- Rescheduling is subject to our availability; we will do our best to accommodate a new date.
- Neither party is liable for failure or delay caused by events beyond its reasonable control (including severe weather, illness, power or internet failure at the venue, or venue closure). Where this prevents the event going ahead, we will work with you to reschedule or refund fees for services not delivered.
4. Your responsibilities and the venue
To allow us to deliver the Services, you (and/or the venue) must provide, at no cost to us:
- safe and timely access to the venue for setup, the event and pack-down;
- a suitable, safe filming position with adequate mains power; and
- where the booking includes live streaming, a stable internet connection adequate for live broadcast, unless we have agreed to supply our own connectivity.
You confirm that you have the authority to permit filming and streaming at the venue, and that you have obtained any permissions the venue requires.
5. Permissions, participants and music
- Filming of people. Events of this kind are public-facing and players, officials and spectators may be filmed and appear in our streams and recordings. You are responsible for informing participants and attendees that the event is being filmed and streamed, and for obtaining any consents required — in particular where children are involved. We can supply signage wording on request, and our Filming & Recording Notice is available to display or share.
- Music licensing. Where music is played at your venue or event and is captured in our broadcast, obtaining and paying for the necessary music licences (for example from PRS for Music and PPL) is your responsibility as the venue or organiser. We are not responsible for music licensing for sound originating at your event.
- Third-party rights. You are responsible for ensuring that the event, and anything you ask us to broadcast, does not infringe anyone else's rights.
6. Recordings, footage and intellectual property
- Ownership. Unless we agree otherwise in writing, Brownz Media owns all copyright and other rights in the footage, recordings, streams, edits and highlight clips we produce, together with our Scoreline broadcast overlays, scoreboards, graphics and software.
- Promotional use. You grant us the right to film, record and live-stream your event, and to use the resulting footage and clips to promote Brownz Media and the sport — including on our website and our YouTube, Facebook, Instagram and TikTok channels.
- Your copy. Unless your quote says otherwise, we will provide you with a copy of the recording of your event for your own use. You may use and share it for your own non-commercial promotion, but you must not resell it or remove our or Scoreline's branding without our written permission.
- Your branding. Any league names, club names, logos or sponsor artwork you give us remain yours; you grant us a licence to display them on the overlays and broadcasts for your event.
7. Live streaming — availability
We use professional equipment and take care to deliver a reliable broadcast, but live streaming depends on factors outside our control, including venue power, internet connectivity and third-party platforms such as YouTube and Facebook. We do not guarantee that a stream will be uninterrupted, error-free, or free of issues caused by those factors, and we are not liable for interruptions arising from them.
8. Insurance
Brownz Media holds public liability insurance covering our on-site work. Details are available on request. You remain responsible for the safety, suitability and insurance of your venue and event.
9. Liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under English law.
Subject to that, and to the fullest extent permitted by law:
- we are not liable for any indirect or consequential loss, or for loss of profits, revenue, anticipated savings, data, goodwill or business opportunity;
- we are not liable for losses arising from interruptions to a live stream, from issues with venue power or internet, or from the acts of third-party streaming platforms; and
- our total liability arising out of or in connection with a booking is limited to the total fees you have paid us for that booking.
We provide the Services with reasonable care and skill. This section does not affect any rights you may have as a consumer that cannot be excluded by law.
10. Data protection
We handle personal data in accordance with our Privacy Policy. Where you provide us with personal data about other people (for example a roster of players), you confirm you are entitled to do so. Where we both act as controllers of personal data captured at an event, each party is responsible for its own compliance with data protection law.
11. Suspension and termination
We may suspend or end the Services if you materially breach these Terms (including non-payment), if required by law, or if continuing would be unsafe. Sections that by their nature should survive termination — including sections 6, 8, 9 and 12 — will continue to apply.
12. General
- These Terms are the entire agreement between us in relation to a booking and supersede any prior discussions.
- If any provision is found to be unenforceable, the rest remain in force.
- We may update these Terms from time to time; the version in force when you confirm a booking applies to that booking.
13. Governing law and jurisdiction
These Terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, although if you are a consumer you may also be able to bring proceedings in your country of residence.
